General Terms of Use

By accessing and using the website of Rachelle’s Lab, you agree to be bound by the following terms of use and to take responsibility for compliance with any applicable local laws.

In these terms of use:

“Rachelle’s Lab Owned Content” means, to the extent it is protected copyright work, and is not expressly marked as “Other Content”, all or any part of any text, image, video or any other type of media in any format contained and comprised in the Website.
“Other Content” means all or any part of any text, image, video or any other type of media in any format contained and comprised in the Website and expressly marked as the copyright property of a third party, property in the public domain, or property in open access databases.
“The User” or “you” refers to any person who books a service via the Website, views or subscribes to the Website.

1. Copyright

1.1 The Chinese texts and images used on the Website are either from the public domain (e.g. Wikipedia), databases with open data licences (e.g. Shuhua diancang ziliao jiansuo xitong 書畫典藏資料檢索系統, National Palace Museum, Taipei), online libraries that permit reasonable use (e.g. ctext.org), or original work created for the Website.

The Website and Rachelle’s Lab Owned Content (including but not limited to translations, blog posts, images, videos, etc.) are protected under international copyright law.

1.2 Permission is granted for fair use of Rachelle’s Lab Owned Content for private non-commercial purposes. The User may:

download, save, and print any pages of the Website for the User's private use;
download, save, and print any pages of the Website for non-profit academic use only, on the condition that the User credits Rachelle’s Lab whenever using them;
quote reasonable amounts of Rachelle’s Lab Owned Content for illustrative purposes, on the condition that the User credits Rachelle’s Lab whenever using them.

1.3 If the User wishes to republish or make derivative work based on Rachelle’s Lab Owned Content, please write to contact.rachelleslab@gmail.com to get written permission first and make sure to credit Rachelle’s Lab whenever using its content.

1.4 If the User wish to use Rachelle’s Lab Owned Content for any other purposes, including commercial purposes, please write to contact.rachelleslab@gmail.com to get written permission first.

1.5 Rachelle’s Lab has made reasonable efforts to provide links to external resources freely available to the public and to identify any content in which a third party owns copyright. It is the User's responsibility to check out the copyright of Other Content and secure any permission or consent required for his/her own use of any content in which a third party owns copyright.

2. Payment, Cancellation and Refund Policy

2.1 Payment (General)

2.1.1 Payment methods and account details are to be discussed once the order is confirmed in writing.

2.1.2 For private commissions only: smaller orders at a fixed price (no more than 1000 euros) are to be paid in full by the due date on the invoice / confirmation of order. Commissions of a larger scale or concerning long-term or open-ended projects may be paid in instalments (details to be discussed and agreed upon).

2.1.3 If the payment is not received by the due date stated on the invoice / confirmation of order, Rachelle's Lab reserves the right to postpone the handing of the assignment.

2.2 Private Tutorials / Consultation Sessions

2.2.1 In principle, you can always reschedule a booked session before it takes place free of charge. Please notify Rachelle’s Lab about any change of plan as early as possible, even if you cannot decide when to reschedule the session yet.

2.2.2 Cancellation is defined as cancelling a booked session without any plan of rescheduling. If a booked session is cancelled, the amount of refund depends on the situation. Specifically:

2.2.2.1 If you cancel a tutorial more than 24 hours before the booked time slot, you can get a full refund.

2.2.2.2 If a tutorial is cancelled by Rachelle's Lab, you can get a full refund.

2.2.2.3 Cancellation within 24 hours before the booked time slot is considered short notice and eligible for a 60% refund.

2.2.3 Failure to join a booked session without any prior notice (max. waiting time: 20 minutes) is not eligible for a refund.

2.3 Translation, Proofreading, and Customised Service

2.3.1 If Rachelle's Lab cancels the order due to force majeure, you will get a full refund.

2.3.2 After the details of the assignment are agreed upon, you will receive an invoice or a confirmation of order from Rachlle's Lab with a free cancellation date (usually the day before the planned start of the work). You can get a full refund of the payment that has been made if the assignment is cancelled before the free cancellation date. If you cancel it after that date, you may be eligible for a partial refund depending on how much deliverable work has been done.

2.3.3 If Rachelle's Lab misses the agreed deadline of delivery without notice, you will get a 10% refund for each working day of delay.

2.3.4 After Rachelle's Lab delivers the work, you may request light revision or clarification on specific issues if necessary. Rachelle's Lab reserves the right to request follow-up payment if the additional work is estimated to exceed 30% of the workload of the original assignment.

2.3.5 Unless otherwise stated, the terms above serve as general guidelines for all orders at Rachelle's Lab. The payment and cancellation policy may be subject to adjustments depending on the specific content and requirements of each order and is to be agreed upon between you and Rachelle’s Lab in writing.

4.1 Rachelle’s Lab has taken every effort and care in preparing the Website. However, Rachelle’s Lab disclaims all warranties, express or implied, as to the accuracy thereof and its fitness for a particular purpose. The content of the Website shall at all times constitute work in progress which may be changed without notice.

4.2 Rachelle’s Lab shall not be liable for any loss or damage arising from your use of or reliance on the Website.

4.3 Links within the Website may lead to other websites. They are provided for convenience only. Rachelle’s Lab is not responsible for any changes to the websites outside rachelleslab.com and all its subdomains or for any loss or damage arising from your use of or reliance on these other websites.

Rachelle’s Lab may revise these Terms of Use at any time. The major modifications and updates will be listed on this page, but minor changes may be made without notice. By using the Website and services offered at Rachelle’s Lab you are agreeing to be bound by the then current version of these terms of use.
